SCOPE OF APPLICATION
These general terms and conditions of sale (hereinafter referred to as the “GTC”) as well as the “Personal Data” and “Legal Notices” sections are applicable to the merchant website shop.myriam-kparis.com (hereinafter referred to as the “Myriam•K Paris® Online Store”), offering the sale of cosmetic products of the Myriam•K Paris® brand (hereinafter referred to as the “Products”) intended for delivery in mainland France, Corsica, Monaco (excluding PO boxes) and Europe (hereinafter referred to as the “Territory”).
Any order on the Myriam•K Paris® Online Store constitutes full and complete acceptance of these General Terms and Conditions by the customer who makes a purchase there (hereinafter referred to as the “Customer”). These General Terms and Conditions can be saved and/or printed and are accessible from all pages of the Myriam•K Paris® Online Store. These General Terms and Conditions may be subject to modification at any time, the applicable General Terms and Conditions being those that the Customer accepts when placing their order, and which are accessible from the order confirmation email.
The site “ shop.myriam-kparis.com ” (hereinafter referred to as the “Site”), presenting in particular the Myriam•K Paris® online store, is published by the company MK FRANCE, a simplified joint-stock company with a share capital of 100,000.00 euros whose registered office is located at 55 Rue Pierre Charron 75008 Paris. It is registered with the Paris Trade and Companies Register under number 52786424300011 and under intra-community VAT number FR 35527864243. The name of the publication director is Youcef Bennadja in his capacity as president.

The Myriam•K Paris® Online Store allows MK FRANCE to offer the sale of Products to non-professional Customers who are consumers, aged over 18 and have full legal capacity. Sales are made at retail for strictly personal use. Consequently, MK FRANCE limits the order to four (4) copies of the same reference within the limit of fifteen (15) products purchased by the same Customer.

PRODUCTS
The Products offered for sale on the Myriam•K Paris® Online Store are described and presented with the greatest possible precision (specifications, illustrations, size, composition, etc.). However, the Customer is invited to refer to the description of each Product, available by clicking on each “Product Sheet”, in order to know its properties and particularities, in particular with regard to the characteristics sought, the choice and purchase of a Product being placed under his sole responsibility.
PRICE
The prices applied are those appearing on the Myriam•K Paris® online store at the time of the order.
The Customer is informed that prices are subject to change. Therefore, if the Customer has created a customer account, the prices displayed in the "My account / My orders" section on the order summary page correspond to the prices paid by the Customer at the time of their previous orders. The functionality allowing the Customer, from this page, to reorder a product is therefore likely to offer the same product for sale at a price different from the price paid on the day of the previous order. The Customer is therefore invited to pay attention to the price in effect at the time of the order and when the product is added to the shopping cart.
Prices will be displayed in Euro (€) including VAT, and do not take into account the costs of delivery of the order (hereinafter referred to as the “Delivery Costs”). These Delivery Costs will be indicated to the Customer on the shopping cart validation page as well as on the order summary page, before validation and payment of the order.

PAYMENT PROCESS AND SECURITY
After validating your shopping cart, you will be redirected to the payment page of our partner Systempay for optimal security. The payment page does not belong to MyriamK Paris, and no payment information will be transmitted or stored on the MyriamK Paris website.
Once the order is accepted, you will be redirected to the website shop.myriam-kparis.com to see the summary of your order.
Please be careful not to close the payment page before being redirected to our confirmation page, which provides your order number. You will also receive a confirmation email.
MyriamK Paris reserves the right to refuse to process an order if it does not provide all the necessary guarantees to ensure compliant and secure payment and in the event of suspicion of fraud or illegal activity according to French and European laws.
All orders require payment. Appropriate legal action will be taken in the event of fraudulent payment.
3-D SECURE
To ensure a secure transaction, MyriamK Paris may use the 3D Secure protocol for authentication purposes. After entering your credit card details, you will be redirected to your bank's online page or application to comply with its authentication protocol.
REFUND PROCESS
In the case of a physical return, please follow the instructions explained in our General Conditions of Sale, under the heading: Canceling your order & return policy.
RIGHT OF WITHDRAWAL
Upon receipt of the request, your refund will be processed within 1 to 2 business days.
Depending on your financial institution, it may take 5 to 7 business days for your account to be credited.
Please note that we do not accept returns in or from our physical stores.

The order is only validated by the Seller after acceptance of the General Terms and Conditions and verification and confirmation of the validity of the payment.
In any event, the Seller reserves the right to refuse any order or delivery in the event of (i) exceeding the limits indicated in the “PAYMENT” article herein, (ii) an existing dispute with the Buyer, (iii) total or partial non-payment of a previous order by the Buyer, (iv) refusal of authorization for payment by bank card by banking organizations, (v) non-payment or partial payment.

Orders
To place an order, the Buyer must first log in to the Site. The Buyer then has the option of viewing the various Products offered for sale on the day of consulting the Site and choosing their Products by (i) browsing the various Product categories or (ii) entering the name of the Product directly into the search engine.
While browsing the Site, the buyer wishing to place an order can do so by simply clicking on the button intended to add the Product to the shopping cart. Once this operation is completed, the Buyer will see the number of Products in their cart displayed. We draw the Buyer's attention to the fact that the contents of the cart may be subject to an expiration period.
The Buyer can then continue their visit or click on their shopping cart to see the contents of their cart displayed on the screen, including all the elements of the order and in particular the essential characteristics of the Products, the total amount of the order, the billing and delivery details, delivery times, costs and possible delivery restrictions as well as the legal rights and guarantees available to the Buyer. The Buyer can return to this order, complete it, modify it, cancel it as long as they have not validated it. If the Buyer wishes to choose other Product(s), they can continue browsing the Site, being assured that the Product(s) they have just selected are kept in their shopping cart.
The Buyer has the possibility, at any time during the order process - namely until the effective payment of the latter under the conditions provided for in these General Terms and Conditions - to return to this order, to complete it, to modify it, to cancel it, and this, as long as he has not definitively validated it.
Once the selection of Products is complete, the Buyer can order them by confirming the order using the button provided for this purpose. A new page then opens inviting the Buyer to either:
- enter their username (email address) and password if the Buyer is already registered on the Site,
- accurately complete a personal data collection form by filling in the mandatory fields, including Last Name, First Name, Email Address, Billing Address, Delivery Address (address to which delivery can be made during business hours from Monday to Friday in France). The Buyer undertakes to complete the form made available to him in good faith. The Buyer acknowledges that the data he communicates to the Seller and which is stored in the information systems of the Seller and/or its subcontractors is accurate and constitutes proof of his identity. It is recalled that this personal data is governed by the Personal Data Policy accessible here . After having read the status of his order, the Buyer is invited:
- either to click on the button allowing access to payment of the order, under the conditions described in these General Terms and Conditions,
- either to click on the button allowing him to modify his basket and/or the information relating to his personal details.
In order to limit the risk of fraud, an order on the Site can only be validated if the Buyer's basket reaches a minimum total amount of €5 (five Euros) including tax (excluding delivery costs) and does not exceed a maximum total amount of €1,000 (one thousand Euros) including tax (excluding delivery costs).
By clicking on the button giving access to the payment of the order, the Buyer must first read these General Terms and Conditions, then secondly, confirm their agreement to all of the General Terms and Conditions by implementing an acceptance confirmation action required on the Site (such as by checking a box).
Once the Buyer confirms their acceptance of the T&Cs, a web page dedicated to payment of the order opens.
The Buyer must then pay for their order under the conditions described in these General Terms and Conditions.
It is specified that by choosing immediate payment by credit card, the Buyer will then be automatically switched to the payment service provider's electronic payment server. The payment service provider's server is secured by SSL (Secure Socket Layer) encryption in order to protect all data related to payment methods as effectively as possible, and that at no time will the Buyer's banking data pass through the Seller's computer system. The Seller is therefore not liable.
The data recorded by the Seller constitutes proof of all transactions between the Seller and the Buyer. Subject to the specific provisions for online sales, the Company Ma jolie cure cannot be held responsible for any direct or indirect damage, whatever the cause, origin, nature and consequence, arising from the consultation or use of the Site.
In particular, La Société Ma jolie cure declines all responsibility in the event of interruption or inaccessibility of the Site, the occurrence of bugs, or any damage resulting from fraudulent acts by third parties (such as intrusion) from the Site.

Order confirmation
Once the order has been confirmed and payment validated in accordance with the terms set out below, a printable and saveable summary of the Buyer's order is displayed and includes the order references.
An order confirmation email is sent as soon as possible by the Seller to the email address provided by the Buyer and includes the following information:
- the identity of the Seller and his contact details;
- the order reference recorded at the time the order was placed;
- the summary of the order and the essential characteristics of the products;
- delivery times, costs and possible delivery restrictions;
- the total amount of the order, including all taxes;
- the legal rights and guarantees available to the Buyer;
- confirmation of payment.
The Seller retains ownership of the Product(s) ordered until full payment of the price and its accessories, including shipping costs, by the Seller.
In the event of a payment incident, the Buyer undertakes to return the products received to the Seller upon first request.
In order to protect the Seller from abusive practices carried out by fraudsters, and in the event that the Seller or the online payment service provider suspects the fraudulent nature of an order, they reserve the right to ask the Buyer (prior to processing the order) for additional documents (in particular proof of address and debit in the name of the Buyer, photocopy of the Buyer's identity card, photocopy of the Buyer's bank card) in order to verify that it is not fraudulent.
In the absence of a response from the Buyer within fifteen (15) days following the sending of the request by the Seller or the online payment provider, the order will be cancelled and the Seller will proceed within fourteen (14) days following the expiry of the aforementioned period to reimburse it using the payment method used by the Buyer.
PROOF OF ORDER
It is expressly agreed between the Seller and the Buyer that electronic mail is authentic between the Parties, as are the automatic recording systems used on the Site, in particular with regard to the nature and date of the order.
The Buyer may access, where applicable in accordance with the rules of common law, the electronic contract concluded between the Buyer and the Seller. To do this, he should contact Customer Service here , to which he will provide all the necessary information to do so, in particular the order number and his contact details.
The company Ma jolie cure is the only one authorized to use the intellectual property rights relating thereto.
The use of all or part of the Site, including downloading, reproduction, transmission, representation or distribution for purposes other than your personal and private use, whether for commercial or non-commercial purposes, is strictly prohibited. Violation of these provisions will subject you to the penalties provided by law.
When you use the "Share" function offered on the Site in order to discover a product, an event or a communication from the Ma jolie cure brand, you acknowledge and accept that the content made available for sharing must only be used for purely personal use, excluding any commercial use on websites or internet pages and/or any other digital medium for commercial purposes.
The creation of hypertext links to the Site may only be done with the prior written authorization of La Société Ma jolie cure , which authorization may be revoked at any time.
All sites with a hyperlink to the Site are not under the control of the company Ma jolie cure and the latter therefore declines all responsibility (particularly editorial) concerning access to and the content of these sites.
The company Ma jolie cure is free to modify, at any time and without notice, the content of the Site.
Delivery and order status
Delivery to another recipient and/or gift:
You can have your purchase shipped to a delivery address different from the billing address (if you wish, for example, to have it delivered to your workplace or to have a gift sent) as long as both addresses are located within the perimeter stipulated in the General Conditions of Sale, in the Delivery Terms.
When making a purchase, during the delivery address selection step, you simply need to indicate the desired delivery address.
Important information:
For your security, your billing address must match the address on your credit card statement used for payment. We reserve the right to cancel any order that does not meet these criteria.
Delivery tracking and confirmation
Once your order is complete, you will receive a confirmation email. As soon as a tracking number is assigned to your package, you will receive another email in which the tracking number provided will be used to track your package.
Status of your order:
You can also find your order's tracking number and status in the "My Account" section.
Log in with your credentials to access your account. You can access your orders in "My Orders," which displays the date, amount, and status of each order. You can click "Details" to view the details of your order.
DELIVERY TERMS Once the order has been prepared, it is sent to the postal address provided by the Buyer when placing the order. The Products are delivered by the service provider CHRONOPOST (depending on the case and/or the delivery options selected). In the event of the Buyer's absence, the Carrier reserves the right to drop off the package at a nearby relay point available the next day. In the event of an anomaly in the delivery, the buyer must then contact the Carrier to agree on a new delivery date. It is nevertheless specified that if the Buyer does not contact the Carrier again, the package is returned to the sender within 7 days. The Buyer is informed that the package is kept by the Carrier or relay point for a period of 7 (7) days after the first presentation, before being returned to the sender.
Time limit
Orders paid by credit card are processed within a maximum of one (1) working day.
Please note that an order is only dispatched once it has been processed.
From the processing of the order, the corresponding Products are transported and delivered by the Carrier within the following timeframes:
- delivery to a relay point by Points Relais: 72 hours (three (3) working days)
- express delivery by Chronopost: 48h/72h (two (2) to (three (3) working days)
Sundays and public holidays are not considered working days.
In any event, the order is executed within a maximum period of thirty (30) days from the day following that on which the Buyer validated his order, subject to full payment of the price and compliance with the purchasing conditions defined in the article “Purchase Conditions” of these General Terms and Conditions.
In the event of non-delivery by the end of this period, the Buyer has the option of cancelling his order under the conditions set out in the article “Delay in Delivery” below.
DELIVERY DELAYS
If the maximum delivery time of thirty (30) days is exceeded, the Buyer may exercise his right to cancel the order with Customer Service HERE
From the exercise of the right of withdrawal, the Seller will reimburse all sums paid by the Buyer (delivery costs included), according to the payment method used within a maximum period of fourteen (14) days from receipt of the withdrawal, to the exclusion of any other compensation.
In the event of partial delivery, delivery may be made in several installments, and this right only concerns the undelivered balance of the order.
Any delay in delivery must be reported as soon as possible by the Buyer by email by clicking HERE , so that the Seller can have an investigation carried out by the Carrier. The Buyer is informed that the time taken to carry out an investigation is random and can be relatively long, as the Seller has no control over its implementation.
If during this investigation the order is found, it is immediately rerouted to the delivery location designated in the order.
If, at the end of this investigation, the loss of the order is confirmed, the seller will, at its own expense, reship the Product(s) to the Buyer or, in the event of permanent unavailability, reimburse the Buyer for the sums collected to the bank account debited when the order was placed.
Cancellation and return
Cancel your order

Our warehouse prepares orders in the morning from Monday to Friday (excluding public holidays). If you wish to cancel your order, please contact our Customer Service by clicking here.
If the order has not yet been prepared, we may cancel it.
Otherwise, if your order has already been prepared, we will not be able to cancel the order but you will still be able to refuse the package upon delivery directly from the Carrier and we will reimburse you upon return of the package.

Occasionally, orders or parts of orders may be cancelled by our system for various reasons:
One or more items are no longer available for sale;
Difficulties were encountered in the payment process;
The package cannot be sent to the given address
The order was placed twice

Return policy
All return and refund requests must be returned, at your expense, within a maximum of fourteen (14) days after the delivery date. The product must be returned to us in its original packaging, accompanied by the delivery slip and the return slip.
If your entire order is returned under the conditions stipulated above, we will refund the full amount of your original order. Otherwise, if you do not return all the products in your order, we will refund the amount of the returned product, excluding the initial shipping costs.
If you received a promotional gift, please include it with your return.
Your account will be credited as soon as possible after receiving your return. You will receive an email confirming receipt of your package and the progress of your refund.
For any exchange request, simply return the product to us as indicated above and place a new order on the E-boutique.
Please note that only products purchased from the online store shop.myriam-kparis.com can be returned.

Damaged product(s)
If your package has been damaged during transport, you must make full and precise reservations on the delivery slip upon receipt of the package. The right of recourse is exercised against the carrier. (In accordance with Article L.133-3 of the French Commercial Code, any reservation must be confirmed by registered letter to the carrier within three (3) days of receipt.)
Then set aside the package and the merchandise(s) and notify our Customer Service as soon as possible by sending one or more photos by email. Don't forget to include your order number and contact details in the email.
Reception
Each delivery is deemed to have been made upon the Product(s) being made available to the Buyer by the Carrier.
It is the Buyer's responsibility to immediately check the conformity and integrity of the Product(s) shipped upon receipt of the Product(s).
Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be reported fully and precisely by the Buyer on the receipt provided by the Carrier at the time the Products are made available and/or confirmed by registered letter to the Carrier within three (3) days following receipt of the order.
Any reservation of this type must be notified in parallel and as soon as possible to the Seller's Customer Service HERE . A copy of the complaint addressed to the Carrier must be attached.
In the event of a data entry error, particularly in the delivery address, resulting in a delay or impossibility of delivery, the seller cannot be held responsible. All costs related to the reshipping of products and the cost of products due to a data entry error by the customer will be borne by the latter.
Legal guarantees
In accordance with Articles L 211-4 et seq. of the French Consumer Code, the Seller is required to deliver goods that comply with the order placed by the Buyer and must be liable for any lack of conformity existing at the time of delivery of the latter. As such, to comply with the contract, the goods must:
1° Be suitable for the use usually expected of a similar good and, where applicable:
- correspond to the description given by the Seller and possess the qualities that the latter presented to the Buyer in the form of a sample or model;
- present the qualities that a Buyer can legitimately expect in view of the public statements made by the Seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Buyer, brought to the attention of the Seller and which the latter has accepted.
Likewise, in accordance with Article 1641 of the Civil Code, the Seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the Buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
If the Products delivered are non-compliant with the Products ordered by the Buyer or if they have hidden defects, the latter must send an email to the Seller's Customer Service HERE to notify them of the non-compliance or hidden defects of their Product(s). In accordance with Article L 211-12 of the Consumer Code and 1648 paragraph 1 of the Civil Code, the Buyer has a period of two (2) years from delivery of the Products purchased to exercise the warranty against hidden defects or the legal guarantee of conformity.
Any claim made after this period of two (2) years from the date of taking possession of the goods in the event of non-conformity or from the discovery of the defect in the event of hidden defects will be rejected and MyriamK Paris will be released from all liability.
The Seller's Customer Service acknowledges receipt of the Buyer's request and confirms the procedure to follow.
Upon receipt of instructions from the Seller's customer service, the Buyer returns the non-compliant products or those affected by a hidden defect to the seller.
The Product(s) must be (i) returned complete, unused, in its (their) original packaging intact and (ii) accompanied by its (their) original packaging as well as the return slip provided by the Seller's customer service and the invoice.
Furthermore, the Seller does not accept:
(i) packages sent postage due. Any risk associated with the return of the Product(s) is the responsibility of the Buyer.
(ii) packages dropped off directly at a Relay Point. Any return order dropped off at a Relay Point cannot be processed and therefore cannot be refunded.
Upon receipt of the Product(s) presumed to be non-compliant or affected by a hidden defect, the Seller will carry out an inspection of the Product(s) to determine whether or not said Product(s) are compliant.
Similarly, the Seller may carry out a quality test on the Product(s) returned by the Buyer to verify that the returned Product(s) are indeed original Product(s). It is understood that these checks are carried out as soon as possible and within a maximum period of one (1) month.
If the non-conformity of the Product(s) is confirmed or the hidden defect is proven, the Seller will then proceed, at the Buyer's choice:
- either to the reimbursement of the non-compliant Product(s) or affected by a hidden defect as well as the shipping costs, according to the payment method used by the Buyer, within fourteen (14) days after receipt of the non-compliant Product(s),
- or to the exchange of the non-compliant Product(s) or affected by a hidden defect at the request of the Buyer. The sending of the Product(s) to the Buyer is done at the expense of the Seller and according to the conditions of these General Terms and Conditions.
Cancellation Policy
The buyer has a reflection period of fourteen (14) days, starting from the day of actual receipt of the order, to return the Product(s) ordered, without having to provide reasons or pay penalties.
The Buyer then has 14 days to return the complete, unused product(s), in its (their) original packaging intact and, where possible, accompanied by its (their) original packaging as well as the return slip and a copy of the invoice.
If the products are not returned within fourteen (14) days from the date of actual receipt of the order, the order is deemed final and no refund may be made, except in the cases provided for in these General Terms and Conditions.
Upon receipt, the Seller acknowledges receipt of this request by sending an email or letter.
The Seller undertakes to reimburse the Buyer for all sums paid. The reimbursement will be made using the payment method used by the Buyer, within a maximum period of fourteen (14) days after the Buyer exercises the right of withdrawal.
Reimbursement of this amount may however be deferred until the returned goods have been recovered.
The return is the responsibility of the Buyer.

Personal data
Personal information
The provision of personal information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential and is only used by the Seller or its subcontractors, subject to the same obligations, as for the processing of orders placed and in accordance with the Personal Data Policy available here.
It is recalled that the Buyer has the right to access, modify, rectify and delete personal information collected concerning him.
To exercise this right, the Buyer can send a message to the Seller's Customer Service here.
The buyer may receive informational emails from the Seller about the Seller's products and activities, if the buyer has previously consented to this. The buyer retains the right to refuse such communication either a priori by not giving his consent at the time of order validation, or a posteriori by expressing his refusal by email by clicking here.
Miscellaneous stipulations
a. Force majeure
Neither Party shall be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure.
Events meeting the criteria set by the case law of the Court of Cassation and legislation are considered to be cases of force majeure.
The Party invoking an event constituting force majeure must notify the other Party within five (5) working days following the occurrence of this event.
The Parties agree that they must consult each other as soon as possible in order to jointly determine the terms of execution of the order during the duration of the force majeure event.
Beyond a period of one (1) month of interruption due to force majeure, the Seller may not honor the order, with the responsibility of reimbursing the Buyer where applicable.
b. Partial invalidity
If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.
c. Entire Agreement
These General Terms and Conditions and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties.
In the event of any contradiction between these documents, the T&Cs shall prevail.
d. Modification of the T&Cs
It is specified that the Buyer may save or print these General Terms and Conditions provided that they are not modified.
The current T&Cs can be consulted at any time under the heading “General Terms and Conditions of Sale” accessible via all pages of the Site.
The Seller may update these General Terms and Conditions at any time. Such an update will be subject to prior and specific notification on the Site.
e. Applicable law
These General Terms and Conditions and the contractual relations between the Buyer and the Seller are subject to French law.
